This is the Privacy Policy governing your use of CargoKey.com and its subsidiary sites. Our Privacy Policy tells you about how we use and protect your personal information. You can access our Web sites home page and browse our sites without disclosing your personal data. When you register on CargoKey you are required to disclose certain personal data to us, and you will no longer be anonymous. By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal data as described in this Privacy Policy. 1.       Financial Information - Credit and Debit Card are not stored on CargoKey's servers but on the secure servers of our payment services provider.
2.       Communication Data - Community discussions, chats, dispute resolution, correspondence through our sites, and correspondence sent to us.
3.       Site Interaction Data - Content and advertising data, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information.
4.       3rd Party Data – These will only be requested when we require them (eg. you incur a debt with CargoKey), and they will only be collected as permitted by law.
 
If we wish to use your personal data for a new purpose, we offer you the means to consent to this new purpose: by indicating in a box at the point on the site where personal data is collected.
 
We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you don't wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference once you sign-on in My CargoKey or by following the directions provided in an email or from a link on the advertisement.
 
We automatically log personal data by means such as programming or we link information automatically logged by such means with personal data about specific individuals.

There are circumstances under which CargoKey will disclose personal data. These circumstances are:

+         To respond to legal requirements,
+         To enforce our policies or,
+         To respond to a claim that a listing or other content violates the rights of others.
 
We may also share personal data with:
 
+         Our subsidiaries and other members of our corporate family (such as CargoKey), to assist in detecting and preventing potentially illegal acts and provide joint content and services. Our corporate affiliates will only send marketing communications to users who request their specific services.
+         Law Enforcement officials, but only in response to a valid request relating to an alleged crime or other illegal activity. In these circumstances we will only disclose the information relevant to the investigation that is required to be provided by the relevant legal authority.
+         Service providers under contract who help with our business operations (such as fraud investigations, account collection, and affiliate rewards programs).
+         Other third party entities that you explicitly permit us to disclose your personal data to.
 
Without limiting the above, and in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not disclose your personal information to law enforcement, government officials, or third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your CargoKey username or password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal data and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify CargoKey and change your password.
 
 
 
Accessing and Reviewing your Personal Data
 
 
You can always access certain Personal Data that we keep about you through My CargoKey.
 
Should you require a full readable copy of all of the data which we have on record about you, you can request it by contacting us. We will require proof of your identity before providing this information to you and will charge an administrative fee of €15.00.
 
We allow you to challenge the data that we hold about you and, where appropriate, you may have the data:
 
+         rectified or amended
+         completed
 
Generally, we will not manually modify your personal data because it is very difficult to verify your identity remotely. You must promptly update your personal data if it changes or is inaccurate.
 
We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, and enforce our User Agreement, and take other actions otherwise permitted by law.
 
 
 
How your Username is used on CargoKey
 
 
Your username and the feedback related to your username are displayed in multiple areas on CargoKey. Your bidding, purchasing, listing and selling history are associated with your username as well as feedback comments, storefront and other content provided to CargoKey.
 
Notices are sent to other community members regarding suspicious activity and policy violations on our sites and refer to usernames and specific items. If you associate your name or company name with username, the people to whom you have revealed your name will be able to personally identify your CargoKey activities.
 
 
 
Use of Data acquired from CargoKey
 
 
CargoKey encourages its users to disclose their privacy practices and to respect the privacy of others. You may share personal or financial data with other users when entering into a transaction with them. CargoKey cannot guarantee the privacy or security of your data and therefore we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information with them.
 
CargoKey only allows limited access to other users' contact, shipping and financial data to facilitate transactions. When users are involved in a transaction, they may have access to each other's name, user name, email address and other contact and shipping information.
 
You must always give other users the opportunity to remove themselves from your database.
 
By accepting the terms of this Privacy Policy, you agree to only use data acquired from CargoKey for:
 
+         CargoKey related transactions
+         Service that are offered through CargoKey (e.g. escrow, insurance, shipping and fraud complaints), or
+         Other purposes that a user expressly chooses.
 
CargoKey does not tolerate spam (unsolicited email). Users may not add any personal data to any mailing lists (email or physical mail) or databases without their consent. This includes users who you have entered into a transaction with.
 
Furthermore you may not use CargoKey’s communications tools to send spam. CargoKey randomly scans and filters messages to check for spam or any other malicious or prohibited activity.
 
To report and spam, spoof or phishing emails to CargoKey, please forward the email to spam@CargoKey.com or spoof@CargoKey.com.
 
If you disclose your information to others, whether they are bidders, buyers or sellers on our sites or other sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. CargoKey does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal information to others.

CargoKey processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. When we receive formal written complaints at this address, it is CargoKey's policy to contact the complaining user regarding his or her concerns.
